Terms & Conditions for Yellow Boat Tours

Welcome to Yellow Boat Tours. By booking a trip, participating in an excursion, attending camp programs, or using our website, you agree to the following Terms & Conditions. Please read them carefully.

1. General Agreement

Yellow Boat Tours (“we,” “our,” or “us”) provides private boat tours, charters, camps, and related experiences in and around Wilmington and Wrightsville Beach, North Carolina. By booking or participating in any service, you acknowledge that you understand and accept these Terms & Conditions.

2. Reservations & Payment

Deposits / Payment

A deposit or full payment may be required at the time of booking to secure your reservation.

Reservations are not guaranteed until payment is received and confirmation has been sent.

Pricing

Prices are subject to change without notice until booking is confirmed.

Quoted custom charter pricing may vary depending on trip length, group size, requested services, fuel usage, and special accommodations.

3. Cancellation & Rescheduling Policy

Guest Cancellations

Cancellations made 14+ days before trip date may receive a refund minus any non-refundable processing fees.
Cancellations made 7–13 days before trip date may receive partial refund or credit at our discretion.
Cancellations made less than 7 days before trip date may forfeit deposit/payment.
No-shows are non-refundable.

Weather Cancellations

Safety is our priority. If weather or unsafe conditions require cancellation, we may:

reschedule your trip, or
issue credit, or
issue refund at our discretion.

Light rain or passing showers may not qualify for cancellation if conditions remain safe.

4. Arrival & Late Policy

Guests should arrive on time at the designated meeting location.

Late arrivals may shorten trip duration or be considered a no-show depending on scheduling constraints.

5. Safety Rules

All guests must follow captain and crew instructions at all times.

We reserve the right to end or refuse service without refund if any guest:

behaves dangerously
is excessively intoxicated
threatens staff or others
damages equipment
violates safety instructions

Life jackets and safety equipment are provided as required by law.

6. Assumption of Risk

Boating, swimming, island exploration, wildlife encounters, fishing, kayaking, and outdoor coastal activities involve inherent risks including but not limited to:

slips / falls
weather changes
water hazards
marine life encounters
seasickness
physical exertion

Guests voluntarily participate at their own risk.

7. Children & Minors

Minors must be accompanied by a parent/legal guardian unless participating in an approved supervised camp program.

Parents/guardians are responsible for disclosing medical, behavioral, or safety concerns.

8. Summer Safari Camps

Camp bookings may have limited spots and are reserved upon payment.

Parents must provide emergency contact information and any relevant health or allergy details.

Yellow Boat Tours reserves the right to dismiss participants for unsafe or disruptive behavior if necessary.

9. Swimming Ability

Some experiences may involve water access, beach landings, shallow wading, kayaking, or optional swimming.

Guests are responsible for honestly assessing their own swimming ability and notifying us of limitations.

10. Personal Property

Guests are responsible for their own belongings including phones, cameras, bags, coolers, jewelry, and valuables.

Yellow Boat Tours is not responsible for lost, stolen, or water-damaged items.

11. Photos & Media

We may occasionally take photos/videos during trips for promotional use.

If you prefer not to be photographed, please notify us before departure.

12. Custom Charters

Custom experiences are subject to route, tide, weather, timing, and captain approval.

Not all requests can be guaranteed.

13. Website Use

All content on this website, including logos, images, text, and branding, is property of Yellow Boat Tours unless otherwise noted.

Unauthorized use or reproduction is prohibited.

14. Limitation of Liability

To the fullest extent permitted by law, Yellow Boat Tours shall not be liable for indirect, incidental, special, or consequential damages arising from participation in our services.

Total liability shall not exceed the amount paid for the booking.

15. Governing Law

These Terms shall be governed by the laws of the State of North Carolina.
